Terms of Service.

These Terms of Service (“Terms”) govern your use of the Ultra website (the “Site”) and the services offered by Ultra (the “Services”). By using the Site or Services, you agree to these Terms.

Description of Services

Ultra provides a platform for users to rent padel and pickleball courts (“Court Rentals”) through the Site. Ultra does not own or operate the courts and is not responsible for their maintenance or safety. Users are responsible for their own equipment, safety, and conduct while using the courts.

Eligibility

You must be at least 18 years old to use the Site and Services. By using the Site or Services, you represent and warrant that you are at least 18 years old.

User Accounts

To use the Services, you must create a user account on the Site. You are responsible for maintaining the confidentiality of your account login information and for any activity that occurs under your account. You agree to notify Ultra immediately of any unauthorized use of your account.

Court Rentals

You may reserve Court Rentals through the Site. Ultra will confirm your reservation by email or phone. You agree to pay the rental fee and any applicable taxes and fees at the time of reservation.

You may cancel a reservation up to 24 hours in advance of the rental time for a full refund. If you cancel within 24 hours of the rental time, you will be charged a cancellation fee of 100% of the rental fee.

You are responsible for your own equipment, safety, and conduct while using the courts. You agree to follow all court rules and regulations, including those posted at the courts and provided by Ultra.

Payment

You agree to pay all fees and charges associated with your use of the Site and Services, including Court Rentals and any applicable taxes and fees. All payments are final and non-refundable, except as provided in Section 4.

Prohibited Conduct

You agree not to:

• Use the Site or Services for any illegal purpose or in violation of any local, state, national, or international law

• Post or transmit any content that is unlawful, offensive, threatening, abusive, or defamatory

• Harass, stalk, or harm another person

• Impersonate or falsely represent your affiliation with any person or entity

• Introduce any virus or other harmful component into the Site or Services

• Interfere with the operation of the Site or Services or the servers or networks used to make the Site or Services available

• Use any robot, spider, scraper, or other automated means to access the Site or Services

• Attempt to gain unauthorized access to any portion of the Site or Services

General

When you opt-in to the service, we will send you a message to confirm your signup.

By opting into messages, you agree to receive recurring automated marketing and informational text messages from Ultra Padel for Ultra Club. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Ultra Club. Ultra Padel reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Ultra Padel also reserves the right to change the short code or phone number where messages are sent.

Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Carriers

Carriers are not liable for delayed or undelivered messages.

Cancellation

You can cancel any time by texting "STOP". After you send the SMS message "STOP", we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Ultra Padel again, just sign up as you did the first time and Ultra Padel will start sending messages to you again.

Transfer of Number

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at ultrasupport@ultraclub.me. The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes

We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes

The Site and Services, including all content, graphics, logos, and software, are the property of Ultra or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Site or Services without the express written consent of Ultra.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ULTRA DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. ULTRA DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability
